What is a Vaccine Injury:  Vaccines work by prompting our immune system to recognize and attack foreign invaders. But on rare occasions, one's immune system has a case of mistaken indentity and attacks our cells instead, like friendly-fire in battle. More Information About the Vaccine Injury Compensation Program 

Immunizations, while beneficial, do carry a small risk of catastrophic adverse reactions. In 1988, Congress created the Vaccine Injury Compensation Program (VICP) to compensate the unfortunate individuals injured each year by vaccines. Compensation is funded by a 75 cent charge on every vaccination. A specialized court within the  Court of Federal Claims in Washington D.C. decides whether the vaccine caused the injury and if the injured person will be compensated. 

VICP claims are often very complex and are defended vigorously by the attorneys with the Department of Justice. The cases usually require extensive and expensive medical research and expert testimony.

The cases filed in the VICP are for injuries that are debilitating, painful, and costly. Because serious adverse reactions to vaccines are rare, treating physicians often do not make the connection between the disease and the vaccine. Most patients, physicians, and even lawyers are unaware of the Vaccine Injury Compensation Program. Important Notice Regarding Flu Shots & Guillain-Barre Syndrome

Guillain-Barre Syndrome (GBS) can strike anyone, and it can be triggered by flu shots and other vaccines. Most people recover from GBS, but it is a long and painful process.

The Health and Human Services Department has approved changes to the Vaccine Injury program that could improve one's chances of obtaining compensation, especially with regard to flu vaccine-induced Guillain-Barre Syndrome (GBS) and shoulder injuries related to vaccines (SIRVA). The time for filing the claim will be extended from three years to approximately eight years. Anyone who has acquired GBS or a shoulder injury following a flu vaccine should consult an attorney knowledgeable about vaccine litigation.
